PARKING LICENSE AGREEMENT
This Parking License Agreement (“Agreement”) governs all access to and use of the Big Rig Park facility (“Facility”). By creating an account, reserving a parking space, entering the property, using a gate code, or parking any vehicle or trailer, the Driver, Vehicle Owner, Motor Carrier, and/or Customer (“User”) agrees to all Terms, Conditions, Rules, Regulations, Waivers, and Policies of the Facility.
1. ACCEPTANCE OF TERMS
Use of the Facility constitutes the User’s full and legally binding acceptance of this Agreement. Acceptance is electronic and enforceable. Continued use of the Facility constitutes ongoing agreement to all current and updated policies.
2. AUTHORIZED USE ONLY
The Facility is intended solely for:
- commercial trucks,
- tractors,
- trailers,
- fleet vehicles, and
- approved commercial equipment.
Unauthorized vehicles are not permitted. The Facility may refuse access or service to any person or vehicle at its discretion.
3. PARK AT YOUR OWN RISK
All vehicles, trailers, cargo, and personal property are parked or stored at the User’s sole risk. The Facility does not assume responsibility for:
- theft,
- vandalism,
- fire,
- weather damage,
- cargo loss, or
- damage caused by third parties.
No bailment is created. The User receives only a revocable parking license.
4. RELEASE OF LIABILITY
To the fullest extent permitted by Florida law, the User releases and holds harmless: Big Rig Park, the property owner, affiliates, managers, employees, contractors, and agents, from any claims relating to:
- vehicle damage,
- theft,
- cargo loss,
- vandalism,
- personal injury or death,
- business interruption,
- towing,
- flooding or weather events, or
- criminal acts of third parties.
The User assumes all risks associated with use of the Facility.
5. INSURANCE REQUIREMENTS
All vehicles entering the Facility must maintain:
- valid registration,
- current insurance, and
- any legally required permits.
Proof must be provided upon request.
6. SECURITY DISCLAIMER
Any fencing, lighting, cameras, gate systems, patrols, or access controls are provided solely as deterrents. The Facility does not guarantee security, surveillance, or uninterrupted access.
7. TOWING & REMOVAL
The Facility may tow, boot, relocate, disable, or remove any vehicle at the owner’s expense for:
- nonpayment,
- expired reservations,
- unauthorized parking,
- safety violations,
- abandoned equipment,
- blocking access,
- hazardous conditions, or
- unlawful activity.
By using the Facility, the User authorizes such towing or removal.
8. PROHIBITED ACTIVITIES
The following are strictly prohibited on the property:
- illegal drug use,
- unlawful activity,
- weapons violations,
- excessive noise,
- open flames or fires,
- dumping fluids or hazardous waste,
- overnight habitation unless expressly permitted,
- alcohol consumption,
- fighting or harassment,
- solicitation or loitering,
- littering.
9. VEHICLE OPERATIONS
Users must:
- obey all posted signs,
- follow directional markings,
- comply with speed limits,
- park only in designated spaces,
- avoid excessive idling, and
- operate vehicles safely at all times.
A property speed limit of 5–10 MPH applies. Idling should not exceed 15 minutes except for lawful operational needs.
10. REPAIRS & MAINTENANCE
The following are not permitted without written authorization:
- major mechanical work,
- fluid changes,
- welding,
- tire disposal,
- dismantling,
- washing that produces runoff.
Only emergency roadside-type repairs are allowed. Users are responsible for all cleanup costs.
11. HAZARDOUS MATERIALS
Unlawful storage or discharge of fuel, chemicals, hazardous materials, biohazards, or flammable substances is prohibited. Any spill must be reported immediately. The User is responsible for all cleanup, remediation, fines, and environmental claims.
12. PAYMENT TERMS
Parking fees are due in advance and may auto-renew. Fees are non-refundable except where required by law. Failure to pay may result in denied access, termination, towing, or collections.
13. FACILITY RIGHTS
The Facility may suspend or terminate access at any time for:
- rule violations,
- safety concerns,
- nonpayment,
- disruptive conduct, or
- unlawful activity.
Termination may occur without prior notice.
14. DAMAGE CAUSED BY USER
The User is responsible for all damage caused by the User, their employees, passengers, contractors, guests, vehicles, trailers, or cargo, including damage to:
- gates,
- fencing,
- pavement,
- utilities,
- landscaping,
- buildings,
- drainage systems.
15. LICENSE ONLY
This Agreement grants a temporary, revocable parking license. It does not create tenancy, leasehold rights, warehouse rights, bailment, or any property interest.
16. GOVERNING LAW
This Agreement is governed by the laws of the State of Florida. Venue for disputes shall be in the appropriate court located in or near Groveland or Lake County, Florida.
17. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
